We argued that the presence of the leak constituted a nuisance and the Defendant’s employees failed to act promptly and reasonably in containing the leak. The Defendant denied liability, stating that the leak was not foreseeable, that it could not have been prevented as the vehicle was subject to maintenance and daily vehicle checks, further, reasonable steps were taken by their staff to contain the leak.

Outcome

The case went to trial and the Judge preferred our client’s evidence. The Judge did not accept that enough steps were undertaken by the Defendant and its employees to cordon the area, contain the leak and prevent pedestrians walking through the fluid.

The Judge awarded our client ÂŁ5000 for their injury. However, our client had successfully beaten their offer to settle the claim, our client was awarded an additional 10% plus interest.
