Non-molestation and occupation orders can protect you and your family from an abuser. Non-molestation orders detail what a respondent (the person the order applies to) is forbidden from doing, while an occupation order regulates who can live in the family home. What is classed as Domestic Abuse?
Domestic abuse (also often referred to as domestic violence) encompasses a range of behaviours and actions that a person can inflict. While many people may assume that domestic abuse only relates to acts of physical violence, this is not the case.
Domestic abuse includes physical, emotional, sexual, psychological and financial abuse.
Anyone who is a victim of domestic abuse may be coerced into believing that they are at fault. This is not true. When an abuser makes a victim believe that they are at fault for the abusive behaviours, this is known as gaslighting.
What is coercive control?
Coercive control is an offence in and of itself established in the Serious Crime Act 2015. It is a type of domestic abuse which involves behaviour which is designed to manipulate the way a victim acts, thinks and feels.
What is a court injunction?
A court injunction is a legal order which orders someone to or forbids them from taking specific actions.
Court injunctions are used across several legal services. Under the Family Law Act 1996, the two court injunctions that are most commonly used to protect someone from acts of domestic abuse and coercive control are non-molestation orders and occupation orders.
Who can apply for a Non-Molestation or Occupation order?
To be eligible to make a domestic abuse injunction, such as a non-molestation or occupation order, you must be considered an ‘associated person’.
This means that you must be related or associated with the abuser in one of the following ways:
- Are married or were ever married or engaged to be married
- Are or ever were in a civil partnership or agreed to form a civil partnership
- Are or were living together (cohabiting)
- Live in the same household (for example, a flatshare)
- Are related (by blood, marriage, civil partnership or cohabitation)
- Have a child together
- Have or had parental responsibility for the child
- Are or were in an intimate relationship for a significant period
