Kate Sutherland is a Senior Associate working within the Wills, Trust and Probate Department. Kate is incredibly experienced in her field and has acted on behalf of clients in all areas of Probate work for over 10 years and has particular experience in dealing with the following:

  • Difficult and unusual Grants of Representation including Grants de Bonis Non, Cessate Grants, Grants Ad Litem and Double Probate as well as all general Grants
  • The removal of executors under s116 SCA 1981, Civil Procedure Rules (57.13) and s50 Administration of Justice Act 1985.
  • Interpretation of wills and clauses including home made wills, mutual wills and wills with unattested alterations, mistakes or errors and ambiguities.
  • Advising on the powers and rights of executors, trustees and beneficiaries whether in the will or trust document or arising from statutory powers.
  • Variation of Wills and intestacies for Tax purposes
  • Advising trustees on the administration of various types of trusts including their Tax consequences (i.e. under the relevant property regime, bereaved minors and disabled trusts etc)
  • Advising and assisting clients with the preparation and set up of trusts suitable to their needs whether in their wills or inter vivos including protective trusts, disabled trusts, discretionary and life interest trusts and trusts for life policies and asset protection
  • Applications to the Court of Protection for simple deputyships
  • Representation at the Court of Protection in connection with contested deputyships and attorneyships
  • The application for statutory wills and appointment of trustees during Court of Protection proceedings

Kate has many years’ experience in drafting Wills including High Net Worth clients, Trusts and Asset Protection, Probate, Court of Protection, Mental Capacity and Elderly Client matters.
