What Happened?
Our client was jogging through a local park on a tarmac path, when his ankle suddenly turned. This was caused by a raised area of tarmac which had been damaged by tree roots. This caused him to lose his balance and trip, falling to the ground.
Our client was in pain with his ankle for a number of months, during which time his ankle would give way on numerous occasions.

We submitted a claim to the local authority, who denied responsibility for our client’s accident. We reviewed the evidence using our expertise in these types of claims, and did not believe that the local authority could demonstrate that they had a reasonable system for identifying these sorts of defects and making them safe.
We advised our client to issue Court proceedings. We then drafted and commenced proceedings. The local authority maintained their denial of responsibility and defended the claim to a contested trial.
Outcome
The Judge agreed that the local authority was responsible for our client’s injuries and awarded our client the sum of £3,250.
