What Happened?
Our client was at the gym and using a cable crossover machine when the handle suddenly snapped causing them to suffer an injury to their shoulder and neck.

We were able to pursue a claim for our client as a result of the faulty gym equipment and we were able to obtain an admission of liability from the insurers of the gym.
Our client was unable to work for almost six months as a result of the injuries they sustained. We ensured that our client underwent physiotherapy to help their recovery and once completed we obtained medical evidence in support of our client’s claim and began negotiations with the gym’s insurers.
The insurers would not accept our client’s claim for loss of earnings and made an initial offer of just over £5,500. We advised our client that this was significantly below what they ought to receive and this was rejected. The insurers would not accept our client’s entitlement to be repaid their lost earnings.
Outcome
We commenced Court proceedings and further attempts of negotiation. Shortly before a Court hearing, the solicitors acting on behalf of the gym agreed to pay our client just over £18,500.
