Car Accident Personal Injury Claim

Our client was driving their vehicle and approached a roundabout in the left-hand lane waiting for oncoming traffic to pass. The defendant, driving behind our client failed to stop and drove into the rear of the client’s vehicle shunting their vehicle forwards.

The incident caused damage to our client’s vehicle which their own insurer repaired.

After the accident, our client suffered headaches, neck pain and dizziness that affected their balance.

The defendant’s insurer initially offered £1,000 in compensation before medical evidence was obtained. This offer was made just under 3 months after the accident while our client was still experiencing significant symptoms.

We advised the client to wait until their symptoms resolved and to obtain the diagnosis, opinion and prognosis of a medical expert before considering whether to accept the offer.

After obtaining medical evidence from an expert they recommended that our client received physiotherapy, which was provided by the defendant’s insurer.

We used the physiotherapist’s report as evidence to value the client’s claim on the basis that they would fully recover 11 ½ months after the accident.
