Asbestos Claims & Compensation
If you or a member of your family has suffered an injury or illness related to asbestos we understand how much a successful asbestos claim could mean to you.
Our specialist asbestos claims solicitors have years of experience in handling asbestos claims and can help you claim the compensation you deserve.
What Is Asbestos?
Asbestos can be found in many buildings and products and is usually safe if not disturbed. However, if the asbestos dust and fibres are inhaled they can cause fatal illnesses. It can take many years, 20 to 30, from the initial exposure to asbestos until symptoms of the diseases become apparent to those suffering.
Some of the diseases that can develop following exposure to asbestos are:
- Lung Cancer
- Pleural plaques
- Pleural thickening
- Pleural effusion
It is important to talk to your doctor if you have had any past or present jobs with asbestos; have lived with someone who has worked in a job with asbestos risk; you have engaged in DIY or other building situations where you might have been exposed to asbestos or even lived near a building with or that uses asbestos.
Your doctor can then make sure your exposure to asbestos is documented in your medical records; help you with your symptoms and give you advice on how to relieve them; instruct you as to any tests you might need – including whether you should see a specialist.
Claiming For Asbestos Related Illnesses
You normally will have three years to start a court action from the date the injured party becomes aware of the diagnosis. On very rare occasions the limit can be changed but it is best to start proceedings, if you think you or a family member has been injured by the inhalation of asbestos, as soon as possible.
It will then be necessary to investigate the medical issues and obtain evidence to assess and prove the potential value of the claim.
There can be many difficulties with cases that might have “started causing problems” over twenty years ago. In particular, the companies may no longer exist.
Specialist asbestos claims solicitors can find out whether the company, or a responsible successor company, can be found and whether there is any insurance still available.
General damages can be awarded for pain, suffering and the overall loss of quality of life caused by the exposure to asbestos and resulting illness. Specific damages can be awarded to offset the inability to work, medical costs, and ongoing medical treatment.
Claims can be made by the individual suffering from the disease, or by the family of someone who has died from an asbestos-related disease.
There are a number of ways for people suffering from health issues related to asbestos to obtain compensation. You can bring an action against your former employers (or the companies responsible for the exposure to the asbestos); and in some cases you can claim from the Government. It is important to speak to an expert in the area if you believe that you, or a member of your family, have been exposed to asbestos and are suffering as a result.
