Nobody wants to have an accident or injure themselves. However, these things do happen and one aspect of personal injury claims that is frequently overlooked is the rehabilitation of victims after their accident. 

As a result of our years of experience and success with every element of serious personal injury claims, Tinsdills are best placed to advise you on your options in respect of personal injury rehabilitation.

The type and amount of rehabilitation required depends on the type and severity of injury suffered. The co-operation of your opponent’s insurers is necessary and funding for rehabilitation is normally not available if liability for your accident is denied.

The Rehabilitation Code

This is a voluntary code but the personal injury pre-action protocol requires that it is considered and we will always try and secure you rehabilitation from the defendant under its terms. 

The code is not part of the litigation process.

The aim of the code is to help you to make the best and quickest possible medical, social, vocational and psychological recovery.  

Where a defendant agrees to use the code, the first step is usually to arrange what is known as an immediate needs assessment.  This assessment will take place with you and often your partner or close family member and a rehabilitation professional.  The aim is to identify what help and assistance you need to help you to recover.

Following the assessment, the rehabilitation professional will prepare a report with recommendations which the defendant will either agree to or set out their reasons for refusing to fund the recommendations.  The majority of the time the recommendations are approved.

    There will often be monthly meetings with the rehabilitation specialist to check on the goals that have been set and to ensure that you have everything that you need and are progressing well.

    If your claim is subsequently unsuccessful, then the money that has been spent by the defendant cannot be recovered from you unless there has been some dishonesty.

    As is clear from the aims of the code it is not just medical treatment that is considered, but also help to allow you to make the best social, vocational and psychological recovery.  The following are just some examples of the type of help that can be and has been provided to clients of Tinsdills over the years under the code:

    • Contact with the NHS clinicians to clarify what treatment is required and to co-ordinate and possibly expedite this treatment

    • Equipment and aids paid for to help the injured party
    • Help to source tradesman to undertake work at the injured parties’ home
    • Gym membership paid for to help with recovery for both the injured party and their partner
    • Swimming sessions paid for
    • Driving lessons paid for to help rebuild confidence whilst driving
    • Liaising with employers to try and find a structured return to work that suits both the injured person and the employer
    • Courses paid for to acquire new skills to help the injured party back to work
